<br /> Tax Vehicle Fuel Tax but are exclusive of the Federal Tac on gasoline,,
<br /> Duly executed exemption certificates, in a form satisfactory to
<br /> Seller, shall e Furnished Seller by Buyer covering Federal Tac
<br /> exemption.
<br /> Maximum The maximum quantity delivered during the specifted term
<br /> Quantity shall not exceed Buyerfs estimated requ3.rements, as indicated
<br /> herein,, by morw than ten (30) per cent, without the consent of
<br /> Seller. The products to kp delivered hereunder shall be for the
<br /> use of Buyer and Ruyer agrees not to resell said products or allow
<br /> the same to be resold.
<br /> Terms Net cash at time of delivery, except at Sellers option,
<br /> If at any time Buyer shall fail to make any payment due hereunder,
<br /> such failure shall, at Seller's option, be deemed by Seller to I-e '
<br /> a treach of the entire contract and Seller may suspend deliveries
<br /> until such payment has been made or may terminate this contract.
<br /> No such suspension or termination shall, however, affect any
<br /> obligation of Buyer hereunder.
<br /> Charge or Any increase in present taxes or any new tax imposed by any
<br /> `lax governmental authority upon the production, manu:'acture, storage,
<br /> transportation, or sale of any product delivered hereunder, or up-
<br /> on any vessel or pipe Lane used therein, shall be added to the
<br /> price of said product, and shall be paid to Seller in addition
<br /> to said price.
<br /> Prevention In the event Seller is prevented from or hinderod in making
<br /> of deliveries hereunder due to fire, riot, labor disturbances, earthy
<br /> Ilerformance quakes, war, acts of any government (whether foreign or domestic,
<br /> Federal, State, County or Municipal),- accident, total or partial
<br /> failure of transportation or delivery facilities or supplies, or
<br /> any cause beyond its cont?ol, whether similar to the foregoing;
<br /> causes or not, the obligation of Seller to make deliveries during
<br /> the period of such disability or hindrance shall be suspended.
<br /> Breach of in the event of any breach of any clause of this contract,
<br /> Contract Seller, at its option, may terminate this con-craet forthwith.
<br /> The waiver by Seller of any breach of any provision hereof by
<br /> Buyer shall not be deemed to be a waiver of the breach of any
<br /> other provision or provisions hereof by Buyer or of any subsequent,
<br /> or continuing breach of such provision or provisions.
<br /> Containers Seller's iron barrels or drums used ,n making deliveries
<br /> hereunder shall be returned to Seller at point of delivery in good
<br /> condition and within ninety days from date of delivery. All such
<br /> iron barrels or drums not returned as abo-va are to )�a invoiced
<br /> and paid for by buyer at Seven Dollars ($7.00) each.
<br /> Former This contract shah., as of the comneneftme-nt date hereof,
<br /> Contracts cancel and super rsede all prior contracts between Seller and Buyer
<br /> for the purchase and sale of the products named for use at the
<br /> point or points mentioned, and shall cancel and mperaede all
<br /> other arrangements or understandings with regard to prices or
<br /> differentials or relating to credits, bonuses, or• concessions to
<br /> be paid by Seller in connection with the purchase and sale of said
<br /> products for use thereat.
