RESOLUTION NO. 2765 <br /> A RESOLUTION OF THE CITY OF REDLANDS FINDING THAT <br /> PORTIONS OF A CERTAIN STREET ARE UNNECESSARY FOR <br /> PRESENT OR PROSPECTIVE STREET PURPOSES AND ORDERING <br /> THE VACATION OF PORTIONS OF SAID STREET <br /> THE CITY COUNCIL OF THE CITY OF REDLANDS hereby ordains and re- <br /> solves as follows: <br /> SECTION ONE- The City Council of the City of Redlands, having <br /> elected to proceed under the provisions of Division 9, Part 3, Chapter <br /> 2 of the Streets and Highways Code of the State of California, and <br /> having held a public hearing as provided therein, hereby finds from <br /> all evidence submitted that the street described in this resolution is <br /> unnecessary for present or prospective purposes and that the public in- <br /> terest and convenience require the closing of said street <br /> SECTION TWO. The City Council hereby orders the vacation of por- <br /> tions of a street described as follows- <br /> Legal Description for Vacating Portions of Stuart Street <br /> All that portion of public right-of-way adjacent to the Southerly line <br /> of Lot 16, Block C, Central Townsite in the City of Redlands as per Map <br /> recorded in Book 8 of Maps, Page 57 thereof, records of San Bernardino <br /> County, State of California, and more particularly described as follows: <br /> That portion of land which lies adjacent to the Southerly line of Lot <br /> 16 and Northerly of the line described in Document No 526 in Book 7217, <br /> Page 69, of records in San Bernardino County, State of California <br /> SECTION THREE- In the proceeding herein adopted by this City Coun- <br /> cil for vacation of the street described in Section. 2, the City of <br /> Redlands reserves and excepts from the vacation the permanent easement <br /> and right at any time, or from time to time, to construct, maintain, <br /> operate, replace, remove and renew sanitary sewers and storm drains and <br /> appurtenant structures in, upon, over and across any street or part <br /> thereof proposed to be vacated and pursuant to any existing franchises <br /> or renewals thereof, or otherwise, to construct, maintain, operate, re- <br /> place, remove, renew and enlarge lines of pipe, conduits, cables, wires, <br /> poles and other convenient structures, equipment and fixtures for the <br /> operation of gas pipe lines, telegraphic and telephone lines, railroad <br /> lines, and for the distribution or transportation of electric energy, <br /> petroleum, and its products, ammonia, water and incidental purposes, in- <br /> cluding access and right to keep property free from inflammable materi- <br /> als, and wood growth, and to otherwise protect the same from all hazards <br /> in, upon, and over the street proposed to be vacated. <br /> SECTION FOUR: The City Council hereby determines that the vacation <br /> of the street described herein is required by public interest, conven- <br /> ience, safety and welfare. <br /> ADOPTED, SIGNED AND APPROVED the 15th day of July, 1969 <br /> ATTEST: <br /> Mayor of the City of Re nds <br /> Clerk <br /> APPROVED FOR FORM- <br /> a/ Edward F Ta ly or <br /> City Attorney <br />
