made payable to the City of Redlands, Finance Department/Revenue Division, P O Box 3005, Redlands <br /> California, 92373 A late fee of fifty dollars($50)shall be added and due for any payment of rent made <br /> after the tenth of the month Any dishonored check shall be considered as unpaid rent <br /> Section 4 Securitv DeDosit The security deposit shall be retained by City secure compliance <br /> with the terms and conditions of this Agreement and shall be refunded to Tenant within thirty(30)days <br /> after the Premises have been vacated by Tenant, less any amounts necessary to pay City for, (i)cleaning <br /> costs, (ii)cost for repair of damages to the Premises above ordinary weai and tear,and(iii)any other <br /> amount legally allowable under the terms of this Agreement A written accounting of said charges shall <br /> be presented to Tenant within ten(10) days of the Premises being vacated if the security deposit does not <br /> cover such costs and damages,Tenant shall immediately pay said additional costs fol damages to City <br /> Section 5 Use of Premises <br /> A The Premises shall be used by Tenant solely for the purpose of outdoor dining associated <br /> with Tenant's operation of the restaurant facility at 5 East Citrus Avenue <br /> B The Premises shall be occupied within thirty(30)days of the issuance of the Final <br /> Occupancy Permit by the City <br /> C The Premises shall include a two foot easement,as illustrated in Exhibit A,for the <br /> purpose of a collectively required four foot pedestrian pathway that must be maintained within the Park, <br /> as illustrated in Exhibit"A" <br /> D During the term of this Agreement,Tenant shall comply with any other license related to <br /> the operation of the restaurant facility and outdoor dining services, and all applicable state and local laws, <br /> and all applicable rules and regulations established by City including,but not limited to, City's Municipal <br /> Code provisions governing parks <br /> E During the term of this Agreement,City shall retain the right to close the Premises for <br /> itself and at the discretion of any third party bookings for up to three(3)events pei calendar yeai, with <br /> ninety(90)days prior written notice given to Tenant of each such event <br /> F The hours of operation for the Premises shall be limited to 11 00 a in to 2 00 a in, <br /> Monday through Sunday <br /> G Live music may be provided within the Premises, during operating hours only Live <br /> music shall be performed in a manner not to disrupt or cause nuisance to adjoining businesses of the <br /> public <br /> H Tenant shall ensure that all customers have vacated the Premises upon closure of the <br /> restaurant facility at 2 00 a in Tenant shall also be responsible for the securing and vacating of the <br /> adjacent Park facility <br /> I There shall be one sign displayed within the Premises winch identifies Tenants <br /> restaurant <br /> J The Premises shall not result in adverse effects to the health, welfare,peace or safety of <br /> persons visiting,residing,working, or conducting business in the surrounding area <br /> 2 <br /> 11caWp AAgreententsTicense Agreement for Outdoor Dining Services Cheesecvalla 9 S.dacx <br /> r, <br /> r r� <br />
