AMENDMENT TO LICENSE AGREEMENT <br /> This first amendment to the license agreement ("License") dated December 15, 2015, by <br /> and between David Kramer("Kramer") and the City of Redlands, a municipal corporation <br /> ("City") is made effective this 5th day of July, 2017 City and Licensee are sometimes <br /> individually referred to herein as a"Party" and,together, as the"Parties" <br /> RECITALS <br /> WHEREAS, on December 15, 2015, the Parties entered into a License relating to certain <br /> real property described therein located within City's Orange Street Alley, and <br /> WHEREAS,the Parties have recently agreed that revisions should be made to the License <br /> to provide that Kramer shall establish his outdoor dining services within the Orange Street Alley <br /> on or before September 6, 2017, or Kramer's License shall immediately terminate, <br /> NOW, THEREFORE, in consideration of the mutual promises contained herein and other <br /> good and valuable consideration,the receipt of which is hereby acknowledged, the Parties agree <br /> to amend their License as follows <br /> AGREEMENT <br /> Section 1 Section 1 of the License, entitled"Premises," is hereby amended to read as <br /> follows <br /> "Section 1 Premises City hereby grants to Kramer a license to provide outdoor dining <br /> services within City's Park in connection with Kramer's operation of the Cope House <br /> restaurant facility located adjacent to the Park The outdoor dining area subject to this license <br /> consists of 301 square feet (the "Premises") and is more particularly described in Exhibit <br /> "A," which is attached hereto and incorporated herein by this reference Kramer shall <br /> commence outdoor dining services (consisting of chairs, tables, and, at Kramer's option, <br /> mobile divider structures as presented to the City Council of City on July 5,2017)within the <br /> Premises on or before September 6, 2017 Notwithstanding any other provision of this <br /> Agreement,in the event Kramer fails to commence such outdoor during by the date specified <br /> in this section,in accordance with all applicable laws,this Agreement and the license granted <br /> herein shall immediately terminate without any, or finther, action of City" <br /> Section 2 All other terms and conditions of the License shall remain in full force and <br /> effect <br /> 1 ORIGINAL <br /> I 1ca\djm\AgreementsU st Amendment to Cope House Lease Agreement 7 6 17 doe <br />
