finds, based on substantial evidence, that the electric vehicle charging station could have a <br />specific, adverse impact upon the public health and safety The Chief Building Official's <br />decision to require a conditional use permit may be appealed by the applicant to the <br />Planning Commission pursuant to Chapter 106 of this Code <br />F. If a conditional use permit is required, the application for the conditional use permit may <br />be denied if the Planning Commission makes written findings, based upon substantial <br />evidence in the record, that the proposed installation would have a specific, adverse impact <br />upon the public health or safety and there is no feasible method to satisfactorily mitigate <br />or avoid the specific, adverse impact Such findings shall include the basis for the rejection <br />ofpotential feasible alternatives for preventing the specific, adverse impact Such decisions <br />may be appealed to the City Council pursuant to Chapter 106 of this Code " <br />Section 2 This ordinance is not subject to CEQA because the adoption of this ordinance is <br />not a "project" pursuant to sections 15060(c) (2) and 15060(c) (3) of Title 14 of the California <br />Code of Regulations Specifically, this ordinance only establishes a streamline process for electric <br />vehicle charger permits and is merely authorizing administrative activities which will not result in <br />a direct or reasonably foreseeable indirect physical change in the environment <br />Section 3 The Mayor shall sign this ordinance and the City Clerk shall certify to the <br />adoption of this ordinance and shall cause it, or a summary of it, to be published once in the <br />Redlands Daily Facts, a newspaper of general circulation within the City, and thereafter, this <br />ordinance shall take effect as provided by law <br />Paul W Foster, Mayor <br />ATTEST <br />q2,, �-� <br />e Donaldson, City Clerk <br />4 <br />I 10rdinances\Nos 2800 2899 in Word12869 Electric Vehicle Charging Systems Clean.docx <br />
