RESOLUTION NO 7929 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS <br /> DENYING THE APPLICATION FOR MINOR EXCEPTION PERMIT NO 589 <br /> FOR THE PROPERTY LOCATED AT 303 SOUTH MICHIGAN STREET <br /> WHEREAS, Ivan Wenzel filed an application for Minor Exception Permit No 589 to <br /> construct a six foot high solid fence around the front yard of the residential property located at 303 <br /> South Michigan Street (the "Project"), and <br /> WHEREAS,on December 12,2018,the Minor Exception Permit Committee held a noticed <br /> public hearing at 303 South Michigan Street, considered verbal and written testimony of City staff, <br /> the applicant, and any testimony from members of the public, and <br /> WHEREAS, on December 12, 2018, the Minor Exception Permit Committee voted 2-1 to <br /> approve the application for Mi for Exception Pen-nit No 589 subject to conditions of approval <br /> allowing the fence with a maximum height of five feet, fence placement to be installed four feet <br /> back from the front property line on the Michigan Street side, and fence placement not to extend <br /> beyond the side plane of the existing house on the Clark Street side, and <br /> WHEREAS, on December 17, 2018, an appeal was filed by David Cross in accordance <br /> with Section 18 168 100 of the Redlands Municipal Code (the "Appeal"), and <br /> WHEREAS on January 4, 2019, notice of the City Council's public hearing for the Appeal <br /> regarding Minor Exception Permit No 589 was published in the Redlands Daily Facts by the City <br /> Clerk, and <br /> WHEREAS, on January 15, 2019, the City Council held a noticed public hearing on the <br /> proposed Minor Exception Pen-nit No 589 and related Appeal,.considered the staff report and oral <br /> reports, reviewed the minutes of the Minor Exception Permit Committee meeting, and considered <br /> the testimony and written evidence submitted by and on behalf of the applicant and the appellant, <br /> and considered the testimony by members of the public, <br /> NOW,THEREFORE,be it resolved by the City Council of the City of Redlands as follows <br /> Section I The City Council hereby denies the application for Minor Exception Penult No <br /> 589 because,based upon the following required finding of Section 18 168 050(A) of the Redlands <br /> Municipal Code, the City Council determines that the proposed minor exception permit is not <br /> justified or warranted by practical difficulties or unnecessary hardships caused by the property for <br /> which the application was filed, or by the property's surroundings, or by existing physical <br /> conditions or constraints of such property The City Council finds the property is similar to other <br /> corner lots in the neighborhood and throughout the City, and thus the granting of the Exception <br /> Permit is not warranted <br /> Section 2 This Resolution shall be effective upon adoption <br /> 1 <br /> I IResolutcons\Res 7900-7999\7929 Upholding AppeO_MEP 589 docx <br />
