RESOLUTION NO 7967 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS, <br /> ADOPTING THE MEASURE I FIVE-YEAR CAPITAL IMPROVEMENT <br /> PLAN AND RESCINDING RESOLUTION 7884 <br /> WHEREAS, San Bernardmo County voters approved passage of Measure I in <br /> November 2004, authorizmg the San Bernardino County Transportation Authonty to <br /> impose a one-half of one percent retail transactions and use tax applicable in the <br /> incorporated and unmcorporated terntory of the County of San Bernardino, and <br /> WHEREAS, revenue from the tax can only be used for transportation improvement <br /> and traffic management programs authonzed m the Expenditure Plans set forth in <br /> Ordinance No 04-1 of the Authonty, and <br /> WHEREAS, the Strategic Plan requires each local jurisdiction applying for revenue <br /> from the Local Streets Program to annually adopt and update a Five-Year Capital <br /> Improvement Plan, and <br /> WHEREAS, California Public Utilities Code 190300 and Ordinance No 04-1 require <br /> each local jurisdiction to mamtam General Fund expenditures for transportation- <br /> related construction and maintenance activities at the required Maintenance of Effort <br /> base year level in each fiscal year of the adopted Five-Year Capital Improvement Plan, <br /> which for the City of Redlands is $845,866, and <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of <br /> Redlands, as follows <br /> Section 1 This City further determines that approval of this Resolution is exempt <br /> from review under California Environmental Quality Act ("CEQA") pursuant to CEQA <br /> Guidelines section 15273 (a)(4) and 15301(c) as CEQA does not apply to the <br /> establishment, modification, structuring, restructuring, or approval of rates, tolls, fares, <br /> and other charges by public agencies which the public agency finds are for the purpose <br /> of obtaining funds for capital projects, necessary to maintain service within existing <br /> service areas <br /> Section 2 That the Measure I Five-Year Capital Improvement Plan, attached to <br /> this resolution as Exhibit A, is hereby adopted <br /> ADOPTED, SIGNED AND APPROVED this 21st day of May, 2019 <br /> G79ab \tfiV.10 <br /> Paul W Foster, Mayor <br /> ATTEST <br /> J e Donaldson, City Clerk <br /> 1 <br />
