The party of the first part <br />agrees to place stakes where building is to be place IT BEING mutually under stood that W. F. CRUICKSHANK, shall not be responsible for the repair of any <br />defective construction or removal of buildings on the above property as per stak es set by the party of the first part. <br />W. F. CRUICKSHANK does not do any decorating, painting, tinting or sheet metal work. <br />The party of the first part agrees to furnish right of way for clearance of buildings to the street and clearance in front street at new location, <br />The party of the first part agrees to leave a clearance space at the foundation for the removal of house timbers, and further agrees that if the building <br />above mentioned is held up on a new location over thirty (34) days that he will p ay to the party of the second part a reasonable rental charge for the use of said <br />timbers and material supporting the building. W. F. CRUICKSHANK will move the building or buildings as quickly as possible, and deliver same in as good <br />condition as the building will permit, owing to its being raised, moved and lowered again. <br />W. F. CRUICKSHANK agrees to replace any windows or plastering that is broken due to moving, except plastering or stucco that it will be necessary to <br />remove to make clearance for timbers for moving. W. F. CRUICKSHANK is not responsible for any broken windows or damaged plastering or any damage that <br />is in the building prior to the moving of same. <br />Party of the first part agrees to sign for and be responsible for any expenses incurred for water, gas and lights to meter. <br />Party of the first part agrees to disconnect and reconnect plumbing and sewer unless otherwise specified in this contract. <br />Should party of the first part fail or refuse to comply with any term or condition of this contract or to make any payment provided herein when due, and it <br />should become necessary, in the opinion of the party of the second part,. to institute legal action thereon, party of the first part agrees to pay to party of the <br />second part a reasonable sum as attorney's fees and costs. <br />The sale of any building, if the purchase of same by the party of the first part is included in this contract, is made subject to a clear Bill of Sale being <br />delivered out of escrow at the old location. <br />W. F. CRUICKSHANK agrees to carry compensation and liability insurance on all work, also to do the work in a good, workmanlike manner. W.
