HIGHWAYS owns or has possession under an Order of <br />Immediate Possession of the property situated in the County of <br />San Bernardino, State of California, shown on the map attached <br />hereto as Exhibit A. <br />All of this property, as shoTm on Exhibit A, overlies <br />the Santa Ana River Basin or is riparian to a surface stream <br />within the watershed of the Santa Ana River. <br />2. As the overlying owner of said land, HIGHWAYS has <br />the legal right to take such amounts of water as is reasonably <br />needed for beneficial purposes on its property. <br />3. HIGHWAYS hereby appoints the CITY as its agent for <br />the following purposes: <br />a. To produce from the underlying basin, water in <br />amounts reasonably needed for beneficial purposes <br />on HIGHWAYS land, as herein described. <br />b. To supply and deliver this water to HIGHWAYS <br />land for exclusive use thereon, particularly for <br />the purpose of constructing, maintaining, and <br />beautifying the Redlands Freeway. <br />4. HIGHWAYS does not hereby convey to CITY any water <br />right, including its overlying right, but intends that such <br />water and water rights in the San Bernardino Basin should <br />
