A G R E E M E N T <br />THIS AGREEMENT entered into on January 15., 1963, between <br />Security Homes, contractor, and David Duthie and Anne B. Duthie, <br />owners, concerning building construction on the property located <br />at 936 Carob Street, City of Redlands, County of San Bernardino, <br />State of California., described as follows: <br />Lot 37, Crescent Heights Subdivision, Tract No4 19820 <br />in the City of Redlands, as per plat recorded in Book <br />28 of Maps, pages 73, records of said County. <br />IT IS �,G-REED s <br />1. That T erea.s, the driveway leading; from Carob Street to <br />the carport has too steep a grade to conform to the City Building <br />Code, and it is impractical to replace the driveway, and <br />'O.iereas, the present grade of the driveway is too steep to <br />allow adequate use thereof by the owners, and <br />Whereas, each of the parties hereto desire to effect the con- <br />struction of a driveway which will be useable by the owners, the <br />Taa.rties hereto do hereby make this 1'�.gree ent® <br />2. It is agreed that the contractor shall increase the width <br />of the driveway from the present width of 16 feet, to 23 feet, bring- <br />ing the street entrance up to the ;i-�-easterly lot linen The <br />increase in the width of the driveway shall taper from 7 feet at <br />the street, to approximately 32 feet at the halfway point, to 0 at <br />the carport. <br />3, It is farther agreed that the owners do hereby waive the <br />requirement that the grade conforan to the Building Code, and they <br />do hereby relieve the City of Redlands of all responsibility in <br />connection with this waiver. <br />-1- <br />
