I, Frances A. L . Smith, a widow, of the City of Redlands, <br />County of San Bernardino, State of California, party of the <br />first part, do hereby grant, bargain, sell and convey unto the <br />City of Redlands a Public Municipal Corporation, within the <br />County of San Bernardino, State of California, party of the sec- <br />ond part, and to its successors, for the: -uses and purposes and <br />upon the conditions named, all that personal property belonging <br />to the natural history collection of my late husband, Dr.77illiam <br />M. Smith, particularly described as follows, to -wit: <br />u <br />Five cases of ornithological specimens mounted for museum <br />purposes, <br />Four cases of shells, and <br />A collection of corals; of fishes, and of birds not in <br />cases, <br />.11 duly classified and labelled. <br />To Have and To Hold the same to the said party of the <br />second part, and to its successors, forever. <br />Provided always and this gift and grant is made upon the <br />express condition that all of said personal property shall be <br />held without the right to sell or dispose of the same or to di- <br />vert the same to private uses, and it shall be used exclusively <br />for the benefit of students and the public; <br />And Provided Further,.that said property shall be at <br />present placed in the l-idministration Luilding of the University <br />of Redlands; that it may be temporarily stored in a proper and <br />safe room i said building until the completion of the Science <br />uuilding to�'e erected by said University at an early date; that <br />when said S.Cience ,5uilding is ready for occupancy said property <br />or collection shall be arranged and displayed in a suitable fire- <br />proof room in said Science uuilding; <br />And Provided Further, that the said party of the second <br />part shall see to it and require that said collection shall, as <br />aforesaid, be at all times properly arranged. displayed and main- <br />tained in good condition; that students and the public have ac- <br />cess to such collection for study and recreation at reasonable <br />hours and on definite days; that all the said cases and each <br />specimen not in cases shall be appropriately marked with a label <br />bearing the inscription, The Doctor William M. Smith Memorial <br />u ollection; that if at any time the said University or the said <br />party of the second part shall place said collection in a sepa- <br />rate room, said room shall be appropriately marked, The Doctor <br />William M. Smith Memorial Room; <br />And Provided Further, that if at any time the said party <br />of the second oart shall erect a fireproof public building to <br />be used as a public museum; in whole or part, and shall employ <br />and keep a duly qualified curator of said museum, then said <br />party of the second part may remove said collection to said pub- <br />lic museum, to be maintained snd displayed, as above required, <br />for the benefit of the public. It shall be entirely optional, <br />however, with the party of the second part as to whether, in <br />such case, the said collection shall be so removed. <br />And It is Herein and Hereby Expressly Roeorved by the <br />said party of the first part that in case any of the above con- <br />ditions as to the use of said property or collection are broken <br />by the said party of the second part, or its successors in in- <br />terest or estate, then this deed of gift shall become null and <br />1 <br />
