RESOLUTION NO 8192 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS <br />DECLARING CERTAIN CITY -OWNED REAL PROPERTY TO BE SURPLUS <br />WHEREAS, the Surplus Land Act, Government Code section 54220 et seq., defines <br />surplus property as land owned by any local agency that is not necessary for the agency's use, and <br />WHEREAS, staff of the City of Redlands has completed a review of City -owned property <br />and has identified certain sites that may not be necessary for the City's use, as defined by state <br />law, and <br />WHEREAS, the passage of this resolution will not cause a direct physical change in the <br />environment, nor a reasonably foreseeable indirect physical change in the environment and, <br />accordingly, this action is therefore exempt from further environmental review pursuant to section <br />15061(b)(3) of the State Guidelines implementing the California Environmental Quality Act, <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redlands as <br />follows. <br />Section 1 The City Council hereby determines that approval of this Resolution is <br />exempt from environmental review pursuant to section 15061(b)(3) of the State Guidelines <br />implementing the California Environmental Quality Act, as approval of this resolution will not <br />cause a direct physical change to the environment, nor a reasonably foreseeable indirect physical <br />change to the environment <br />Section 2 The City Council hereby declares that those certain City -owned properties, <br />and any rights, title, and interest therein, listed in Exhibit "A," attached hereto and incorporated <br />by this reference, are necessary for the City's use and are declared not surplus <br />Section 3 The City Council hereby declares that those certain City -owned properties, <br />and any rights, title, and interest therein, listed in Exhibit "B," attached hereto and incorporated by <br />this reference, are exempt from Articles II and III of Government Code Section 54220 et seq <br />Section 4 The City Council hereby declares that those certain City -owned properties, <br />and any rights, title, and interest therein, listed in Exhibit "C," attached hereto and incorporated by <br />this reference are no longer necessary for the City's use, and are therefore declared surplus <br />pursuant to Government Code Section 54220 et seq and based upon the following findings <br />Finding The land is surplus and is not necessary for the City's use <br />Evidence The properties were purchased for buffer/expansion purposes for the City's <br />wastewater treatment plant and landfill As surrounding properties developed, the properties are <br />no longer needed as a buffer because the area is now zoned industrial, which permits compatible <br />uses with the City's existing facilities Also, neither the landfill or wastewater treatment plant <br />require the properties for future expansion <br />1 <br />I.1Resolutions\Res 8100 8199\8192 FCS Surplus Property clean.docx <br />
