RESOLUTION NO 8320 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS <br />DELEGATING THE AUTHORITY TO RENDER DE TERMINATIONS RELATING <br />TO DISABILITY RETIREMENT APPLICATIONS TO THE REDLANDS CITY <br />MANAGER AND HIS OR HER AUTHORIZED DESIGNEES (ASSISTANT CITY <br />MANAGER AND ASSISTANT DIRECTOR, HUMAN RESOURCES/RISK <br />MANAGEMENT) AND RESCINDING RESOLUTION NO 7885 <br />WHEREAS, the City of Redlands (herein referred to as the "City") is a contracting agency of <br />the Public Employees' Retirement System, and <br />WHEREAS, the Public Employees' Retirement Law requires that a contracting agency <br />determine whether an employee of such agency, in employment in which he or she is classified as a <br />local safety member, is disabled for purposes of the Public Employees' Retirement Law and whether <br />such disability is "industrial" within the meaning of such law, and <br />WHEREAS, the City Council of the City has determined that is may delegate its authority <br />under Section 21173 of the Government Code to make such determinations to the incumbent of the <br />position of City Manager, and his or her designees, specifically the Assistant City Manager and the <br />Assistant Director of Human Resources/Risk Management, <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF REDLANDS AS FOLLOWS <br />Section 1 That it does hereby delegate, to the incumbent of the position of the City <br />Manager, and his or her authorized designees, specifically the Assistant City Manager and the <br />Assistant Director of Human Resources/Risk Management, the authority to make determinations <br />under Section 21152(c) of the Government Code, on behalf of the City, of disability and whether <br />such disability is industrial, and to certify such determinations and all other necessary information to <br />the Public Employee's Retirement System <br />Section 2 That the incumbent City Manager, and his or her authorized designees, <br />specifically the Assistant City Manager and the Assistant Director of Human Resources/Risk <br />Management, is authorized to make applications on behalf of the City for disability retirement of all <br />employees, and to initiate requests for reinstatement of such employees who are retired for disability <br />Section 3 That City of Redlands Resolution No 7885 establishing disability retirement <br />application procedures is hereby rescinded <br />ADOPTED, SIGNED AND APPROVED thiT th day of April, 2022 <br />ATTEST n Paul T Barich, Mayor <br />e Donaldson, Clty Clerk <br />1 <br />L \ca\Reso\8320 Delegating Authority to Disability Retirement Applications.doc <br />
