Section 1. <br />reference. <br />The above recitals are true and correct and are incorporated herein by this <br />Section 2. The City of Redlands hereby authorizes and directs the Mayor of the City <br />of Redlands, or his designee, to sign and submit an application to the Department in response to <br />the NOFO, and to apply for WaterSMART grant funds for the AMI Project up to the amount of <br />$2,722,500.00. <br />Section 3. If the application is approved, the Mayor, or his designee, is designated to <br />provide the assurances, certifications, and commitments required for the grant application, <br />including executing a financial assistance or similar agreement with the Bureau of Reclamation <br />within established deadlines and any amendments or changes thereto. <br />Section 4. The Mayor, or his designee, is designated to represent the City in carrying <br />out the responsibilities under the grant agreement, including certifying disbursement requests on <br />behalf of the City and compliance with applicable state and federal laws. <br />Section 5. If a grant award is made by the Bureau of Reclamation, the City commits to <br />providing up to $2,722,500 in matching funds for the AMI Project plus any remaining balance <br />noted in the funding plan. <br />Section 6. The City Council finds this Resolution is not subject to the California <br />Environmental Quality Act ("CEQA") in that the activity is covered by the general rule that CEQA <br />applies only to projects which have the potential for causing a significant effect on the <br />environment. Where it can be seen with certainty, as in this case, that there is no possibility that <br />the activity in question may have a significant effect on the environment, the activity is not subject <br />to CEQA. <br />Section 7.' Applicant acknowledges and agrees that it shall be subject to the terms and <br />conditions specified in the Agreement, and that the NOFO and Application will be incorporated in <br />the Agreement by reference and made a part thereof. Any and all activities, expenditures, <br />information, and timelines represented in the Application are enforceable through the Agreement. <br />Funds are to be used for the allowable expenditures and activities identified in the Agreement. <br />Section 8.
