RESOLUTION NO. 8396 <br />A RESOLUTION OF THE CITY OF REDLANDS CITY COUNCIL DENYING AN <br />APPEAL AND UPHOLDING THE PLANNING COMMISSION'S DECISION TO <br />APPROVE CONDITIONAL USE PERMIT NO. 1138, TENTATIVE PARCEL MAP <br />NO. 20475, AND ADOPT A SUSTAINABLE COMMUNITIES ENVIRONMENTAL <br />ASSESSMENT FOR THE CITY CENTER MIXED -USE PROJECT. <br />WHEREAS, Vantage One Real Estate Investments, ("Applicant"), submitted a development <br />application for Conditional Use Permit No. 1138 to construct a mixed -use project with 131 dwelling <br />units and a total of 10,550 square -feet of commercial (restaurant) floor area known as "The City <br />Center" on approximately 3.01 acres located at the northwest corner of N. Eureka Street and Brookside <br />Avenue (APNs: 0171-211-11-0000 through 0171-211-21-0000, 0171-211-25-0000, and 0171-101-01- <br />0000 through 0171-101-05-0000); and <br />WHEREAS, the Applicant submitted an application for Tentative Parcel Map No. 20475 to <br />merge seventeen parcels and subdivide a total of approximately 3.01 acres into two parcels for <br />development purposes; and <br />WHEREAS, the above -referenced applications filed with the City of Redlands are referred to <br />hereinafter as the "Project" and "Project Entitlements"; and <br />WHEREASE, the proposed Project is subject to the California Environmental Quality Act <br />(CEQA), the City has prepared an Initial Study and Sustainable Communities Environmental <br />Assessment (SCEA) for the Project; and <br />WHEREAS, on August 30, 2022, the Planning Commission considered the Initial <br />Study/SCEA, written comments submitted during the 30-day public review period, and the testimony <br />and any written evidence submitted by members of the public; and <br />WHEREAS, on August 30, 2022, the Planning Commission held a public hearing and <br />considered the staff report, oral report, the testimony and the written evidence submitted by staff, the <br />applicant and by members of the public on the Project; and <br />WHEREAS, following the public hearing on August 30, 2022, the Planning Commission <br />determined that approval of the Project is in the best interests of the public health, safety and general <br />welfare and voted unanimously to approve the Project Entitlements; and <br />WHEREAS, Lozeau Drury, LLP, representing Supporters Alliance for Environmental <br />Responsibility (SAFER) ("Appellant"), has filed a timely application on September 9, 2022, to appeal <br />the Planning Commission's approval of the Project Entitlements for the City Center mixed -use project; <br />and <br />WHEREAS, on September 21, 2022, notice of the City Council public hearing was mailed to <br />the owners of record of all properties within 300 feet of the subject property, in accordance with <br />Sections 17.07.060 and 18.192.040 of the Redlands Municipal Code; and <br />1AResolutiomWes 8300-8399\8396 Appe l_Reso_.doc- <br />
