Section 2. Term. The term of this Development Agreement (the "Term") shall <br />commence upon the effective date of the ordinance approving this Development Agreement (the <br />"Effective Date") and shall continue for sixty-five (65) years, until July 17, 2066, unless extended <br />or earlier terminated as provided for in this Development Agreement. <br />Section 3. Development of the Property. The permitted use of the Property, the <br />density and intensity of use, the maximum height and size of proposed buildings, the provisions <br />for the reservation or dedication of land for public purposes, the provisions for public <br />improvements, the City's general plan, zoning ordinances and development plan and regulations, <br />and other terms and conditions of development applicable to the Property, are unaffected by this <br />Development Agreement. <br />Section 4. Definitions. For purposes of this Development Agreement, the following <br />terms and phrases shall have the meanings indicated below: <br />A. "aggregate" shall mean rock, sand and gravel; <br />B. "Business Day" shall mean a day that is not a Saturday, Sunday or legal holiday <br />in California. In the event that the date for the performance of any covenant or <br />obligation under this Development Agreement shall fall on a Saturday, Sunday or <br />legal holiday in California, the date for performance thereof shall be extended to <br />the next day. <br />C. "extracting" or "extraction" shall mean the extracting, mining or excavating of <br />aggregate; <br />D. "processing" shall mean the crushing and screening of aggregate; <br />E. "tax" shall mean any tax, fee, charge, duty, levy, or other assessment of a similar <br />nature, whether imposed directly or through withholding; <br />t,nnocs\2701925 1 -4- <br />
