8/8/02 <br />AMENDMENT NO. I TO THE <br />GRANT FUNDING CONTRACT <br />BETWEEN <br />SANTA ANA WATERSHED PROJECT AUTHORITY <br />AVD <br />CITY OF REDLANDS <br />FOR RECYCLED WATER AND DESALTING <br />THIS AMENDMENT NO. I TO THE GRANT FUNDING CONTRACT is made by and <br />between the SANTA ANA WATERSHED PROJECT AUTHORITY ("SAWPA") whose address is <br />11615 Sterling Avenue, Riverside, California 92503 and CITY OF REDLANDS <br />("CONSTRUCTING AGENCY"' whose address is 35 Cajon, Suite 15-A, Redlands, CA 92373. <br />RECITALS <br />A. Whereas SAWPA and CONSTRUCTING AGENCY entered into a Grant Funding <br />Contract (the "Contract") on April 12, 2002; <br />B. Whereas paragraph 10 of Exhibit "C" to the related SAWPA's Project Agreement <br />with the State Water Resources Control Board, dated March 15, 2002, contains a <br />non-discrimination clause based on existing state law, and that paragraph 10 requires that the <br />non-discrimination clause be included in any agreement between SAWPA and the Constructing <br />Agencies; and <br />C. Whereas it is the intent of SAWPA and CONSTRUCTING AGENCY to amend the <br />above -referenced Contract to include such a non-discrimination clause. <br />AGREEMENT <br />NOW THEREFORE in consideration of the foregoing Recitals and the mutual covenants <br />contained he -rein, the Contract is hereby amended at add a new Section 22 to the Contract's Exhibit <br />A (Grant Funding Contract General Conditions) as follows: <br />SECTION 22. Non -Discrimination Clause. During the performance <br />of the Agreement and this Amendment, CONSTRUCTING AGENCY. and its <br />subcontractors, shall not unlawfully discriminate, harass, or allow harassment against <br />any employee or applicant for employment because of sex, race, color, ancestry, <br />religious creed, national origin, physical disability (including HIV and AIDS), <br />mental disability, medical condition (cancer), age (over 40), marital status, and <br />denial of family care leave. CONSTRUCTING AGENCY, and its subcontractors, <br />shall insure that the evaluation and treatment of their employees and applicants for <br />employment are free from such discrimination and harassment. CONSTRUCTING <br />AGENCY, and its subcontractors, shall comply with the provisions of the Fair <br />
