Larsen and Dorothy A. Larsen, husband and wife, Phillip S. Sirianni and Janice <br />L. Sirianni, husband and wife and Sanford C. Gunter and Velma C. Gunter, husband and wife (Owners) <br />executed and acknowledged a LAND CONSERVATION AGREEMENT (herein "Contract 77-530") on the <br />15th day of February, 1977 which was recorded with the San Bernardino County Recorder on the 22nd day of <br />February, 1977 in Book 9119, Page 1377 of the public records; and <br />WHEREAS, a portion of the land subject to Contract 77-530 (as described on Exhibit "A" hereof) has <br />previously been annexed into the City of Redlands; and <br />WHEREAS, the County of San Bernardino ("County") modified its agricultural preserve effective on or <br />about January, 1982 removing portions of the properties subject to Contract 77-530 from the agricultural <br />preserves of the County of San Bernardino; and <br />WHEREAS, under Section 51236 of the Williamson Act, the effect of removal of land under contract <br />from an agricultural preserve is the equivalent of notice of nonrenewal by the County. In addition, Section 12 <br />of Contract 77-530 provides that "[r]emoval of land under this contract from an agricultural preserve shall be <br />the equivalent of notice of non -renewal by COUNTY..."; and <br />WHEREAS, de facto notice of non -renewal (removal from agricultural preserve) by County became <br />effective on or about January, 1982; <br />1 <br />17942.00153\40920488.1 <br />
