RESOLUTION NO. 8511 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS <br />DECLARING ITS INTENTION TO VACATE A PORTION OF EXCESS TEXAS STREET <br />RIGHT-OF-WAY <br />WHEREAS, TTLC Redland Texas St, LLC, has submitted an application requesting vacation <br />of an approximately 965-foot long segment of excess public right-of-way, one (1) foot in width, <br />along the east side of Texas Street adjacent to APN: 0167-041-01-0000; and <br />WHEREAS, the City is authorized to vacate all or part of a public street or public service <br />easement within the City pursuant to Public Street, Highway and Service Vacation Easements Law <br />(California Streets and Highway Code, Section 8300 et.seq.); and <br />WHEREAS, pursuant to Section 8340 of the California Streets and Highways Code, the <br />City may for public convenience and necessity reserve and except public service easements from <br />a street vacation; and <br />WHEREAS, the street vacation qualifies for exemption from environmental review in <br />accordance with Section 15061(b)(3) of the California Environmental Quality Act (CEQA) <br />Guidelines. Section 15061(b)(3) is the "general rule" exemption where it can be seen with certainty <br />that the activity in question will not have any significant effects on the environment; and <br />WHEREAS, the City Council intends to vacate the excess right-of-way as more <br />particularly described in Attachment "A" to this resolution. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />REDLANDS AS FOLLOWS: <br />SECTION 1. The City Council hereby declares its intention to vacate that portion <br />of Edgemont Drive as further described in Attachment A (Legal Description and Plat), attached <br />hereto. <br />SECTION 2. CALIFORNIA ENVIRONMENTAL QUALITY ACT. The proposed <br />street vacation qualifies for exemption from environmental review in accordance with Section <br />15061(b)(3) of the California Environmental Quality Act (CEQA) Guidelines. Section <br />15061(b)(3) is the "general rule" exemption where it can be seen with certainty that the activity in <br />question will not have any significant effects on the environment. <br />SECTION 3. The City Council will conduct a public hearing on the subject of the <br />proposed vacation at a regularly scheduled public meeting of the City Council on October 3, 2023, <br />beginning at 6:00 p.m. or as soon thereafter as the matter may be heard, to be held in the City <br />Council Chamber located at 35 Cajon Street, Suite 2, Redlands, California 92373. <br />SECTION 4. The City Clerk shall give notice of the public hearing on the public <br />hearing on the proposed vacation by: <br />a.
