SECOND AMENDMENT TO PUBLIC WORKS CONSTRUCTION CONTRACT <br />This second amendment ("Second Amendment") to the Public Works Construction <br />Contract for the 2022 CIP Water Pipeline Replacement Project dated January 17, 2023 (the <br />"Contract"), by and between the City of Redland$, a municipal corporation and general law city <br />("City"), and Tryco General Engineering, a California corporation ("Contractor"), is made and <br />entered into this 19'I' day of December 2023. <br />RECITALS <br />WHEREAS, it is the desire of the City acid Contractor to amend their existing Contract, <br />specifically to amend the time for completion from receipt of notice to proceed within three <br />hundred (300) calendar days of the contract to February 11, 2024; and <br />WHEREAS, the City Council approved thecontract with contractor for work in accordance <br />with the Contract Documents for City's 2022 CIP Water Pipeline Replacement Project, Project <br />No. 501062; <br />NOW, THEREFORE, in consideration of the mutual promises contained herein City and <br />Contractor agree as follows: <br />AGREEMENT <br />Section 1. The time for completion, as set forth in Section 3 of the Contract, is hereby <br />amended to increase Cofitractor's time for completion and shall read as follows: <br />"TIME FOR COMPLETION: The Work shall be completed within three hundred (300) <br />calendar days from and after the date of City's issuance of a Notice to Proceed to <br />Contractor." <br />Section 2. All other provisions of the Contract shall remain unchanged by this Second <br />Amendment, and in effect. <br />IN WITNESS WHEREOF, the parties have executed this Second Amendment, to be <br />effective as of the 19th da of December 2023. <br />CITY <br />LANDS <br />Eddie Tejeda, Mayor <br />ATTEST: <br />ene Donaldson.
