If <br />equipment is returned excessively dirty there may be a cleaning fee. This does not include normal wear and tear under <br />normal usage. <br />TERMS AND CONDITIONS: Lessee agrees to rent above referenced equipment at the stated rate, including all <br />transportation charges. Lessor shall not be responsible for any DOWNTIME, loss of time, damage, or injury, to Lessee or <br />any other party caused by, resulting from, or in any way connected with the use or, failure of, including oil spills caused by <br />machine or hose failures, or any defect on the Lessor's equipment regardless of cause. In no event, shall the Lessor be <br />responsible for special or consequential damage whatsoever or whosoever caused. Lessee will be responsible for normal <br />servicing and maintenance. Lessee is responsible for any abuse due to lack of any lubricant DEF, COOLANT, and OIL or <br />DIRTY FILTERS. Lessee-+ is responsible for any repairs resulting from lack of these fluids. Fuel charges will apply for any <br />machine returned with less than a full tank of fuel. Charges may apply to other fluids as well. Lessee will be responsible <br />for damage to TAILGATES, STEP LADDERS, WINDOWS, MIRRORS, POINTS, TEETH, TIRES, CUTTING EDGES and or <br />ground engaging tools: above and beyond normal wear. In the event said customer fails to pay for the above equipment or <br />labor, said customer agrees to pay attorney fees, court costs and interest of 2% per month (18% APR) for collection. The <br />terms and conditions herein set forth are agreed by Lessee and Lessor, and the Lessee acknowledges that he or she has <br />fully read and agrees to all these terms and conditions which supersede any purchase order or other writing.
