SECTION 1: The above recitals are true and correct and are a substantive part of this Resolution and findings of the City Council. SECTION 2: The City Council hereby declares that the Property is exempt from the Act as exempt surplus land pursuant to Govermnent Code section 54221(f)(1)(D), based on the findings contained in this Resolution for the Property, namely that the City intends to lease the Property to the SCAQMD, another local agency, for the SCAQMD's use of the Property for air quality monitoring purposes, and none of the characteristics listed under Government Code Section 54221(f)(2) apply to the Property. SECTION 3: This Resolution has been reviewed with respect to the applicability of the California Environmental Quality Act (Public Resources Code Section 21000 et seq.) ("CEQA"). City staff has determined that the designation of the Property as exempt surplus does not have the potential for creating a significant effect on the environment and is therefore exempt from further review under CEQA pursuant to State CEQA Guidelines Section 15060(c)(3), because it is not a project as defined by the CEQA Guidelines, Section 15378. Adoption of the Resolution, in and of itself, does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment. SECTION 4: The City Manager or designee is hereby authorized and directed to send a copy of this Resolution to the California Department of Housing and Community Development in accordance with the requirements of Section 400(e) of the SLA Guidelines. SECTION 5: If any section, subsection, paragraph, sentence, clause or phrase of this Resolution is declared by a court of competent jurisdiction to be unconstitutional or otherwise invalid, such decision shall not affect the validity of the remaining portions of this Resolution. SECTION 6: The City Clerk shall certify to the adoption of this Resolution.
