SECTION 1: The above recitals are true and correct and are a substantive part of this <br />Resolution and findings of the City Council. <br />SECTION 2: The City Council hereby declares that the Property is exempt from the Act <br />as exempt surplus land pursuant to Govermnent Code section 54221(f)(1)(D), based on the <br />findings contained in this Resolution for the Property, namely that the City intends to lease the <br />Property to the SCAQMD, another local agency, for the SCAQMD's use of the Property for air <br />quality monitoring purposes, and none of the characteristics listed under Government Code Section <br />54221(f)(2) apply to the Property. <br />SECTION 3: This Resolution has been reviewed with respect to the applicability of the <br />California Environmental Quality Act (Public Resources Code Section 21000 et seq.) ("CEQA"). <br />City staff has determined that the designation of the Property as exempt surplus does not have the <br />potential for creating a significant effect on the environment and is therefore exempt from further <br />review under CEQA pursuant to State CEQA Guidelines Section 15060(c)(3), because it is not a <br />project as defined by the CEQA Guidelines, Section 15378. Adoption of the Resolution, in and of <br />itself, does not have the potential for resulting in either a direct physical change in the environment <br />or a reasonably foreseeable indirect physical change in the environment. <br />SECTION 4: The City Manager or designee is hereby authorized and directed to send a <br />copy of this Resolution to the California Department of Housing and Community Development in <br />accordance with the requirements of Section 400(e) of the SLA Guidelines. <br />SECTION 5: If any section, subsection, paragraph, sentence, clause or phrase of this <br />Resolution is declared by a court of competent jurisdiction to be unconstitutional or otherwise <br />invalid, such decision shall not affect the validity of the remaining portions of this Resolution. <br />SECTION 6: The City Clerk shall certify to the adoption of this Resolution. <br />ADOPTED, SIGNED AND APPROVED this Yd day of <br />Tejeda, Mayor <br />ATTEST: <br />KarIne Donaldson, City Clerk <br />2 <br />IAResolutionslRes 8600-8699\8621 Declaring Real Property Near 500 North Dearborn Exempt Surplus Land.docx-ms <br />
