FIRST AMENDMENT TO FACILITY USE AGREEMENT <br />This First Amendment to the Facility Use Agreement ("Agreement") dated February 5, <br />2024, is made and entered into this 21d day of April, 2024 ("Effective Date"), by and between <br />the City of Redlands, a municipal corporation ("City"), and the Consolidated Fire Agencies <br />("CONFIRE"). City and CONFIRE are sometimes individually referred to herein as a "Party" <br />and, together, as the "Parties." <br />RECITALS <br />WHEREAS, it is the desire of the Landlord and Tenant to amend the existing Lease, <br />specifically with regard to the Lease Terns and Base Rent; <br />NOW, THEREFORE, for good and valuable consideration in the receipt of which is hereby <br />acknowledge Landlord and Tenant agree as follows: <br />AGREEMENT <br />Article 1. Premises. City agrees to permit CONFIRE to use approximately one thousand <br />six hundred seventy-nine (1,679) square feet of office space within the Citrus Center located at <br />300 E. State Street, Suite 340 and approximately eight hundred sixty-six (866) square feet of <br />office space within the Citrus Center located at 300 E. State Street, Suite 320, Redlands, <br />California (the "Premises") on the terms and conditions hereinafter set forth. <br />Article 2. Integration of this Amendment and the _Facility Use Agreement This <br />Amendment and the Facility Use Agreement shall, for all purposes, be deemed to be one <br />instrument. In the event of any conflict between the terms and provisions of this Amendment and <br />the terms and provisions of the Lease or other amendments, the terms and provisions of this <br />Amendment shall, in all instances, control and prevail. Except as expressly defined herein, all <br />words and phrases which are defined in the Lease shall have the same meaning in this Amendment <br />as are ascribed to said words and phrases in the Lease. <br />Article 3. Effect of this Amendment.
