Owner is the owner in fee of one parcel located northeast of the intersection <br />at Tennessee Street and Lugonia Avenue (APNs: 0167-171-15-0000) in the City of <br />Redlands, consisting of approximately 13.48 gross acres of land, and more particularly <br />described in the legal description attached hereto as Attachment 1" (the "Property"). <br />B. Owner has submitted to City plans to develop on the Property, a 460-unit <br />multifamily residential rental development (the "Project"). <br />C. The purpose of this Agreement is to implement the City of Redlands's <br />Inclusionary Housing Ordinance (Redlands Municipal Code Chapter 18.230), and all of <br />the terms, conditions, provisions and covenants set forth in this Agreement shall be <br />interpreted to be consistent with the Inclusionary Housing Ordinance. <br />D. City and Owner desire to enter into this Agreement to place certain <br />covenants and restrictions on the Property and use and operation of the Project, including <br />the imposition of affordability covenants requiring that no less than twenty (20) residential <br />units will be used and occupied or available for use and occupancy by Very Low Income <br />Households as defined in Health and Safety Code Section 50105.
