City and Subdivider are sometimes individually referred to herein as a <br />"Party" and, together, as the "Parties." <br />RECITALS <br />WHEREAS, Subdivider is the owner or authorized developer of property located in the City <br />of Redlands known as Tract No. 20528 (the "Subdivision") for which Subdivider is obligated to <br />construct certain improvements (the "Improvements") as a condition of approval of the Subdivision; <br />and <br />WHEREAS, City desires to ensure that the Improvements will be constructed in a good and <br />workmanlike manner and in accordance with City laws; and <br />WHEREAS, Subdivider acknowledges that it is familiar with the provisions of the Redlands <br />Municipal Code and the State Subdivision Map Act (Government Code section 66410 et seq.) and <br />agrees to comply therewith; and <br />WHEREAS, a final map for the Subdivision has been prepared pursuant to the Redlands <br />Municipal Code and the State Subdivision Map Act, and has been filed by Subdivider for <br />consideration by City; <br />NOW, THEREFORE, in consideration of the approval and acceptance by the City Council <br />of City of the final map for the Subdivision, and the mutual promises contained herein, the Parties <br />agree as follows: <br />I:\cmo\Agreements\Subdivision Improvement Agreement_Meritage Homes (Tract No. 20528) - FY25-0005.doc (AE) <br />
