City and Developer are sometimes individually referred to herein as a "Party" and, <br />together, as the "Parties." <br />RECITALS <br />WHEREAS, Developer is the owner or authorized developer of property located in the <br />City of Redlands specifically described in Exhibit "A" and has received City approval for CRA <br />No. 938 (the "Project"), for which Developer is obligated to construct certain improvements (the <br />"Improvements") as a condition of approval of the Project; and <br />WHEREAS, City desires to ensure that the Improvements will be constructed in a good <br />and workmanlike manner and in accordance with City laws; and <br />WHEREAS, Developer acknowledges that it is familiar with the provisions of the Redlands <br />Municipal Code and agrees to comply therewith; <br />NOW, THEREFORE, in consideration of the mutual promises contained herein, the Parties <br />agree as follows: <br />1. Definition and Ownership of Improvements.
