Box 3005 <br />Redlands, CA 92373-1505 <br />Attention: Planning Division <br />(FOR RECORDER'S USE ONLY) <br />DECLARATION OF RESTRICTIVE COVENANTS FOR URBAN LOT SPLIT <br />This DECLARATION OF RESTRICTIVE COVENANTS FOR URBAN LOT SPLIT ("Declaration") is <br />executed by Mike Guardian ("Declarant") on the signature date set forth below. Declarant promises, agrees <br />and covenants to restrict the development and use of the property described below in accordance with the <br />terms, conditions and restrictions set forth in this Declaration. <br />RECITALS <br />WHEREAS, Declarant is the fee owner of that certain real property located at 10 Cortez Street in <br />Redlands, California, which is also identified as San Bernardino County Assessor's Parcel Numbers 0168- <br />081-21-0000 and 0168-081-19-0000 and which is described in Exhibit "A" attached hereto ("Property"); <br />and <br />WHEREAS, Declarant and/or persons acting on behalf of Declarant applied for, and the City of <br />Redlands ("City") approved, Parcel Map No. 21067 authorizing subdivision of the Property into two (2) <br />parcels in accordance with California Government Code § 66411.7 ("Subdivision"); and <br />WHEREAS, Government Code § 66411.7 establishes certain requirements for urban lot splits, <br />including agency -imposed restrictions on land use and development; and <br />WHEREAS, the purpose of this Declaration is to guarantee that the Property will be used and/or <br />developed in accordance with state law; and <br />WHEREAS, this Declaration is required to memorialize and implement these requirements. <br />NOW, THEREFORE, in consideration of the City's approval of the Subdivision, Declarant hereby <br />covenants, acknowledges and agrees to the following: <br />1. Restrictive Covenants. The following restrictions shall apply to each lot in the Subdivision: <br />A. The Property will only be used for residential uses. Non-residential use is prohibited. <br />B. Rental of any dwelling unit shall be for a term longer than thirty (30) days. <br />C. The City shall not be required to permit more than two (2) dwelling units. <br />D. Redivision by urban lot split pursuant to Government Code § 66411.7 is prohibited. <br />2. Successors and Assign Bound. Declarant hereby agrees and acknowledges that the Property shall <br />be held, sold, conveyed, owned, developed and used subject to the applicable terms, conditions <br />Page 1 of 4 <br />
