STATE WATER RESOURCES CONTROL BOARD ORDER WR-2016-OOXX (Proposed) City of Redlands SETTLEMENT AGREEMENT AND STIPULATION FOR ENTRY OF ADMINISTRATIVE CIVIL LIABILITY ORDER Section I: INTRODUCTION This Settlement Agreement and Stipulation for Entry of Administrative Civil Liability Order ("Stipulation and Order" or "Stipulated Order") is entered into by and between the Director of the Office of Enforcement of the State Water Resources Control Board ("State Water Board"), on behalf of the State Water Board Prosecution Staff("Prosecution Staff') and the City of Redlands ("Settling Respondent") (collectively "Parties") and is presented to the State Water Board, or its delegee, for adoption as an Order by settlement, pursuant to Government Code section 11415.60. Section II: RECITALS WHEREAS, the City of Redlands is alleged to have violated section 865(c)(1) of title 23 of the California Code of Regulations, as described in EXHIBIT A to this Stipulated Order; and WHEREAS, the Parties have engaged in settlement negotiations and agree to fully settle the alleged violations without administrative or civil litigation and by presenting this Stipulation to the State Water Board, or its delegee, for adoption as an Order by settlement, pursuant to Government Code section 11415.60. The Prosecution Staff believes that the resolution of the alleged violations is fair and reasonable and fulfills all of its enforcement objectives. No further action is warranted concerning the specific violations alleged in EXHIBIT A, except as provided in this Stipulated Order, and that this Stipulated Order is in the best interest of the public. Section III: STIPULATIONS The Parties stipulate to the following: 1. Administrative Civil Liability: The City of Redlands hereby agrees to the imposition of an administrative civil liability totaling $61,000.
