��ciar� f / y:-Ei�( <br />-. AGREEMENT <br />�CAS. <br />�ER1 9 11.AITAP, <br />THE CITY OF REDLANDS, hereinafter called "City", and Glenn W. <br />Emmerson and Harland H. Emmerson their assignees, heirs, <br />and successors in interest, hereinafter called "Owner", do hereby <br />agree as follows: <br />The City agrees to relieve Owner of the property described on <br />Exhibit "A" of the responsibility of installing or enclosing drainage <br />facilities along the existing alignment of the drainage canal through <br />the southwesterly portion of said property, which existing alignment <br />is generally shown on Exhibit "A" attached. The drainage improvements <br />consist of installing a reinforced concrete pipe of adequate size to <br />convey storm water through the property as required by the Planning <br />Commission as a condition to approving a building project requested by <br />Owner and identified as Commission Review and Approval No. 288. <br />Owner agrees to perform all maintenance and repairs to the ditch <br />and not to use or present claims for damages from flooding or requests <br />for ditch maintenance to the City of Redlands or any County, State or <br />Federal public agency, hereinafter called "Public Agency", that may <br />be responsible for flood protection in other parts of the city. <br />Owner further agrees to hold harmless the City and any other <br />Public Agency from any damage claims that may be submitted from any <br />adjoining property owners that may be damaged because of protective <br />works, levees, walls or other devices that may divert water from said <br />property onto adjoining properties, and to indemnify the City or any <br />other such Public Agency from such claims_ <br />The City Council has determined that improvements to this <br />portion of the drain will be required within five years of the date <br />of this agreement and the Owner does hereby agree to install all <br />improvements and to pay all expenses for the installation of said <br />improvements as determined by the City Council. <br />This Agreement shall be recorded with the County Recorderls <br />office and shall be binding as a covenant running against the land <br />upon all subsequent owners of tf) property described in Exhibit "A". <br />ATTEST: <br />Cit rk <br />.
