DENNIS WARDLE <br />IC�D� P �S, CA .()Z37 '� CLERK -RECORDER <br />SM BERNARDINO COUNTY, CALIF.. <br />CONSTRUCTION, OPERATION AND EASEMENT AGREEMENT <br />i <br />i <br />i <br />THIS AGREEMENT, made and entered into as of November 1, 1975, <br />by and between the REDEVELOPMENT AGENCY OF THE CITY OF REDLANDS, a <br />public body, corporate and politic, organized and existing under the <br />Community Redevelopment Law of the State of California, hereinafter <br />referred to as "Agency", the CITY OF REDLANDS, a municipal corporation, <br />hereinafter referred to as "City", and REDLANDS MALL ASSOCIATES, a <br />California limited partnership, hereinafter referred to as "Developer", <br />W I T N E S S E T H: <br />WHEREAS, City has adopted and Agency is implementing a <br />Redevelopment Plan for the central part of the City of Redlands pur- <br />suant to the Community Redevelopment Law of the State of California, <br />E a portion of which is to be redeveloped and improved into a retail <br />shopping center and adjacent and subjacent parking facilities, which <br />pox•tion is legally described in Part 1 of "Exhibit A" and is shown on <br />"Exhibit B" attached hereto and incorporated herein by reference, and <br />is hereinafter referred to as the "Site"; and <br />WHEREAS, on or about June 14, 1974, Agency and Developer's <br />predecessor entered into a written Disposition and Development Agreement, <br />which was modified by a written Implementation Agreement entered into <br />by Developer and Agency on or about July 29, 1975, and by a letter agree- <br />ment executed concurrently herewith, v;hich agreements collectively are-. <br />eti . <br />hereinafter referred to as the "DDA", by which Agency agreed, among <br />other things, to acquire the Site and to demolish existing structures <br />and improvements thereon and to convey to Developer certain portions of <br />the Site, which portions are legally described on Part 2 of "Exhibit A", <br />and are hereinafter collectively referred to as the "Developer Tract"; <br />and <br />I <br />
