SECOND AMENDMENT TO AGREEMENT TO PERFORM PROFESSIONAL SERVICES <br />This second amendment ("Second Amendment") to the agreement for professional <br />planning, environmental and development review services ("Agreement"), dated March 29, 2022, <br />by and between the City of Redlands, a municipal corporation and a general law city ("City"), and <br />Michael Baker International, Inc. ("Consultant"), is made and entered into this 6th day of <br />September 2022. <br />RECITALS <br />WHEREAS, it is the desire of the City and Consultant to amend their existing Agreement, <br />specifically to Article 5.1 to increase the payment to the Consultant from one hundred forty-nine <br />thousand nine hundred ninety dollars ($149,990) to two hundred ninety-nine thousand nine <br />hundred ninety dollars ($299,990). <br />NOW, THEREFORE, for good and valuable consideration in the receipt of which is hereby <br />acknowledge City and Consultant agree as follows: <br />AGREEMENT <br />Section 1. Section 5.1 of the Agreement, titled "Payments to Consultant," is hereby <br />amended to read as follows: <br />`5.1 Total compensation for Consultant's performance of the Services shall not exceed the <br />amount of two hundred ninety-nine thousand ninety dollars ($299,990). City shall pay Consultant <br />on a time and material basis in accordance with Exhibit `B," titled "Compensation," which is <br />attached hereto and incorporated herein by this reference." <br />Section 2. All other provisions of the Agreement shall remain unchanged by this <br />Second Amendment and in effect. <br />Section 3.
