regulations promulgated under the Act, specifically 44 CFR § 59.2, in order to qualify for <br />the sale of federally -subsidized flood insurance, the City must adopt and submit to the <br />Federal Insurance Administrator an ordinance adopting flood plain management <br />regulations that satisfy the requirements of 44 CFR Part 60 and that are designed to <br />reduce or avoid future flood, mudslide or flood -related erosion damages and include <br />enforcement provisions. <br />B. While the City of Redlands has adopted the most recent version of the California <br />Building Code and has an ordinance for flood plain management regulations that <br />previously satisfied the prerequisites for the National Flood Insurance Program or the <br />regulations set forth at 44 CFR Part 60, amendments to the City's ordinance are required <br />by October 30, 2025, to continue to satisfy the National Flood Insurance Program or the <br />regulations set forth at 44 CFR Part 60. <br />C. Pursuant to 44 CFR § 59.24, a government entity that is otherwise eligible for the sale of <br />federal flood insurance shall be subject to suspension from the National Flood Insurance <br />Program for failing to submit copies of adequate flood plain management <br />regulations meeting the minimum requirements of 4 CFR Part 60. The Federal Insurance <br />Administrator has provided a deadline of October 30, 2025, for the City of Redlands to <br />adopt the required municipal code text amendment(s) to update the applicable flood plain <br />management regulations contained in the Redlands Municipal Code. <br />D. The City Council finds that the impending loss of community eligibility for discounted <br />flood insurance under the National Flood Insurance Program poses a current and <br />immediate threat to the public health, safety, and welfare presented by floods and related <br />conditions during the upcoming rainy season(s). In the absence of this Urgency <br />Ordinance's immediate effectiveness, the City would be unable to secure eligibility to <br />purchase discounted federal flood insurance for affected community members, as well as <br />to protect the public health, safety, and welfare from the potential adverse effects of lack <br />of insurance coverage to recover from a flood or flood -related disaster. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDLANDS DOES <br />ORDAIN AS FOLLOWS: <br />SECTION 1. Section 15.32.020 of Chapter 15.32 of the Redlands Municipal Code, <br />entitled "Definitions," is hereby amended to read as follows: <br />"15.32.020: DEFINITIONS: <br />The following words shall have the meanings ascribed to them: <br />ACCESSORY STRUCTURE: A structure that is accessory to and incidental to that of the <br />dwelling(s) and that is located on the same structure. <br />ACCESSORY USE: A use which is incidental and subordinate to the principal use of the <br />parcel of land on which it is located. <br />P\Ordinances\Nos 2900-2999 in Word\2991-Flood Damage Pivvention and Floodplain Management.doe-jl <br />
